1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and QuickCreate ("Company," "we," "us," or "our"), the provider of QuickCreate platform, governing your access to and use of the QuickCreate platform, including any related services, features, content, and applications (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

2. Service Description

QuickCreate is a cloud-based Software as a Service (SaaS) platform that provides business management solutions, including but not limited to:

• Point of Sale (POS) system
• Accounting and financial management
• Inventory management
• Customer Relationship Management (CRM)
• Business analytics and reporting
• Multi-tenancy support for multiple business locations

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

3. Account Registration and Eligibility

3.1 Eligibility

You must be at least 18 years old and have the legal capacity to enter into binding contracts to use our Service. By using the Service, you represent and warrant that you meet these requirements.

3.2 Account Creation

4.3 Free Trial

We may offer a free trial period for new users. At the end of the trial period, your subscription will automatically convert to a paid plan unless you cancel before the trial ends.

4.4 Cancellation and Refunds

You may cancel your subscription at any time. Cancellations take effect at the end of the current billing cycle. No refunds will be provided for partial subscription periods, except as required by law.

5. User Responsibilities and Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Violate any applicable laws, regulations, or third-party rights
• Use the Service for fraudulent or illegal activities

You retain all ownership rights to the data you input into the Service. By using the Service, you grant us a limited license to use, store, and process your data solely for the purpose of providing the Service to you.

8. Service Availability and Support

8.1 Uptime

We strive to maintain 99.9% uptime for the Service. However, we do not guarantee uninterrupted access and are not liable for any downtime, including scheduled maintenance or unforeseen outages.

Support is provided according to your subscription plan. Response times and support channels vary by plan level.

8.3 Backups

While we perform regular backups, you are responsible for maintaining your own backup copies of critical data. We are not liable for any data loss.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUICKCREATE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Service interruptions or data loss
• Unauthorized access to or alteration of your data
• Any third-party conduct or content

12. Indemnification

You agree to indemnify, defend, and hold harmless QuickCreate and their affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses arising from your use or misuse of the Service or violation of these Terms.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
